LEIA COM ATENÇÃO O QUE FOI POSTADO POR UM GRANDE MESTRE... Pois é, essa não é a primeira vez. Há alguns casos de pessoas que foram salvas pelo Breitling Emergency. Mas a coisa não é tão simples. É terminantemente proibido usar ele como sinal de socorro sem que seja estritamente uma emergência AÉREA. É crime. Começando do começo: para você comprar um Emergency em uma loja autorizada, você precisa assinar um termo de responsabilidade que lhe é dado após tudo ser explicado, como funciona o treco, e o que acontece se você fizer mau uso dele, e é feito um registro em seu nome. Caso você venda o relógio, deve, teoricamente, transferir esse registro e o termo de responsabilidade. Pois se dispararem o troço, acharem o relógio e puxarem o número de série, podem ir atrás de você e não de quem estava com o relógio na hora. O termo é o seguinte: CONDITIONS OF SALE The BREITLING EMERGENCY watch is equipped with atransmitter that operates on the 121.5 MHz aeronautical distress frequency. Misuse of this transmitter will disrupt air traffic as well as the activities of rescue organisations. For security reasons, the sale of the BREITLING EMERGENCY is subject to the undertaking on the part of the purchaser to comply with the following provisions. 1. The BREITLING EMERGENCY can be sold and used only by individuals who have been informed and have accepted the terms and conditions of sales and the restrictions on use described in this document and in the EMERGENCY INFORMATION booklet. 2. The transmitter cannot be activated, except in clear situations of distress occurring exclusively in the context of aeronautical activities - by pilots or passengers of planes, helicopters, balloons, hot air ballooons, airships, gliders, hang-gliders, para-gliders, ultra light aircraft and by skydivers. 3. Any misuse or use outside the aeronautical context of the BREITLING EMERGENCY transmitter watch may involve penalties and lead to substantial financial expenses, in addition to the cost of rescue operations provoked by the signal of the transmitter, which shall be borne by the user. The owner of the BREITING EMERGENCY shall be fully responsible for the consequences of any misuse of the transmitter, including by third party. Neither BREITLING SA nor the distributor or seller can be held responsible for any misuse of the transmitter. 4. If the BREITLING EMERGENCY transmitter is used without distress, negligently, accidentally, unjustifiably or outside the aeronautical context, the reconditioning cost of the transmitter shall be borne by the owner of the watch, whether the watch is covered by warranty or not. The purchaser is informed that such reconditioning cost is at least equivalent to half the suggested retail price of the BREITLING EMERGENCY watch. 5. In the event of legitimate use of the transmitter, justified by a situation of the distress in the aeronautical context and certified by an official rescue organisation, the BREITLING EMERGENCY watch shall be replaced at no cost in favour of the owner mentioned in this document. 6. The purchaser is informed that the function of the BREITLING EMERGENCY watch is to facilitated the location of the individual in distress but does not activate rescue operations. 7. The purchaser communicates to BREITLING SA the information requested below and undertakes to inform BREITLING SA of any change of ownership, theft, loss or destruction of the watch whose serial number appears on this document. Such information shall be used in compliance with Swiss data protection law and shall only be communicated to third parties nin order to protect BREITLING SA or the sellers' interest for the purposes of enforcing the terms and conditions of this agreement. Ou seja, se não for claramente uma emergência, e exclusivamente com contexto aéreo, você pode ser processado, e aí pode pagar multa, pegar cana, e pagar todos os gastos com o teu salvamento. Mas, o que ocorre na prática? Se o troço for acionado por maldade, como trote, ou sem ter sido claramente uma emergência, você tá lascado e vai ter que pagar todos as despesas (que podem passar fácil de uma centena de milhares de dólares) e ainda puxar uma cana. Mas já ocorreu outras vezes do troço ser acionado em uma emergência com risco de vida a uma ou mais pessoas, mas fora do contexto aéreo. Esse aí é mais um caso desse. Até onde se sabe, a justiça perdoou esses casos pois resultaram claramente no salvamento de vidas, que teriam claramente sido perdidas se não fosse pelo relógio. Então o bom senso prevalece e perdoa o uso fora do contexto aéreo. Até porque, mesmo que pessoa saiba disso, na hora que sua vida está em jogo, fora de uma emergência aérea, você prefere sair vivo, mesmo que tenha que ser penalizado pelo uso ilegal do troço, ou prefere morrer congelado, ou ser devorado por um urso grisalho, ou sei lá o que? Enfim, foi só para explicar que a coisa não é tão simples. A boa notícia é que quem é salvo pelo relógio, além de sair vivo, ganha um Emergency zero bala da Breitling... Contente Abraços! Adriano |
